Changes in Legal Aid for Mediation

The Ministry of Justice has announced that from 3rd November 2014 it will fund both the MIAM (Mediation Information and Assessment Meeting) and the first session of mediation where one of the people involved qualifies for legal aid.

Parties who are financially ineligible for legal aid for mediation will be exempted from the financial means test for the first mediation session where both of the following conditions are met…

  • the other party is financially eligible for legal aid
  • the first mediation session takes place on or after 3rd November 2014

These changes only relate to the first mediation session.  For all subsequent mediation sessions, legal aid for mediation will only be available for the (financially) eligible party.
